Mass Mailings.
We have a zero stance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail
and UCE are defined as: the sending of the same, or substantially similar,
unsolicited electronic mail messages, whether commercial or not, to
more
than one recipient. A message is considered unsolicited if it is posted
in violation of a newsgroup charter or if it is sent to a recipient
who
has not requested or invited the message. UCE also includes e-mail with
forged headers, compromised mail server relays, and false contact information.
This prohibition extends to the sending of unsolicited mass mailings
from
another service, which in any way implicates the use of SilverStar WebDesigns
Inc. whether or not the message actually originated from our network.
Sending Unsolicited
Bulk Email ("UBE", "spam").
The sending of any form of Unsolicited Bulk Email through our servers
is prohibited. Likewise, the sending of UBE from another service provider
advertising a web site, email address or resource hosted on our servers,
is prohibited. Our accounts or services may not be used to solicit customers
from, or collect replies to, messages sent from another Internet Service
Provider where those messages violate this Policy or that of the other
provider.
Mailing Lists:
Ours mass mailing rules also apply to mailing lists, list servs, or mailing
services you may contract with. The policy is stated as follows: An acceptable
mailing list will be focused at a targeted audience that has voluntarily
signed up for your e-mail information or that has made their e-mail address
available for distribution of information from you. The list must also
allow for automatic removal by all end Customers with non-distribution
in the future.
Running Unconfirmed
Mailing Lists. Subscribing email addresses to any mailing list without
the express and verifiable permission of the email
address owner is prohibited. All mailing lists run by our customers must
be Closed-loop ("Confirmed Opt-in"). The subscription confirmation
message received from each address owner must be kept on file for the
duration of the existence of the mailing list. Purchasing lists of email
addresses from 3rd parties for mailing to from any Silverstar hosted
domain, or referencing any SilverStar hosted account, is prohibited.
Email lists must
be 100% Opt-In, and comply with the Can-Spam act. For details, please

If your actions have
caused our mail servers or our IP address ranges to be placed on blackhole
lists and other mail filtering software systems used by companies on the
internet, you will be assessed a $600 charge to your account and $350
per hour for administrative charges incurred to remove and protect mail
servers and IP ranges.
Violation
of the above terms will result in one or all of the following:
- A warning
from via email or phone.
- Removal
of DNS for the advertised / originating site.
- Temporary
shutdown of the server or a block on outgoing mail.
- IP address
routing to null.
- Account
Suspension
- A service
fee assessed to your account for violation.
Repeat
violation of the above terms will result in the following actions.
- Immediate
disconnection of service with no re-activation.
- $600
fee assessed to your account for violation and
$350 per hour for administrative charges incurred to remove
and protect mail servers and IP ranges.
Email Forwarding to AOL addresses: AOL uses spam detection and complaint
resolution policies that are hostile towards forwarded email, and as
a result generate a high level of complaints. We reserve the right to
remove any email forwarder that generates SPAM complaints from AOL.
Here's the key 5 things you have to do to be CAN-SPAM compliant in a
nutshell:
- Make sure every piece of information in headers is accurate, true, and
in no way misleading.
- Include an opt-out link. Immediately and zealously honor opt-out
and unsubscribe requests.
- Include your physical business address.
- Indicate if the email is an advertisement.
- Clearly mark sexually explicit material.
In addition, these 7 rules will help keep you out of trouble.
- Don't send to harvested email addresses. Remember, Harvesting Emails
is against our terms.
- Don't use automated means to guess email addresses.
- Don't use an automated process to sign up for multiple email or user
accounts.
- Don't send email from or through any computer to which you don't
have access or user permission.
- Don't send email that contains misleading, deceptive, or fraudulent
header information or content.
- Don't continue to send email to someone who opted out or unsubscribed
from your mailing list.
- Don't share or otherwise transfer to anyone the email address
of someone who opted out or unsubscribed from your mailing
list.
In short, don't add
people to your mailing lists unless they very specifically asked to
be added. That includes grabbing addresses from their websites
or business cards. Be certain you use clear and descriptive titles for
your mailings. Honor unsubscribe and remove requests promptly and remove
any bounced or rejected addresses immediately. Include your full contact
information and a short "You are receiving this email because you
asked for it" type note in the footer of your message.
Following these guidelines will greatly reduce the chances for complaints
and help us to keep our servers off of the various blacklists that are
there to stop spammers.
